Agreement to Terms

Welcome to Modern Floorzz. By using our services, requesting an estimate, or entering into a contract with us for flooring installation, you agree to be bound by these Terms of Service. Please read them carefully.

These Terms constitute a legally binding agreement between you (the “Client” or “you”) and Modern Floorzz (“we,” “us,” or “our”). If you do not agree to these Terms, please do not use our services.

Services Provided

Modern Floorzz provides professional flooring installation services, including but not limited to:

  • Luxury Vinyl Plank (LVP) and Laminate Installation
  • Tile Installation (ceramic, porcelain, natural stone)
  • Carpet Installation
  • Hardwood and Engineered Wood Installation
  • Commercial Flooring Installation

All services are provided in accordance with industry standards and manufacturer specifications.

Estimates and Quotes

Free Estimates

We provide free, no-obligation estimates for flooring projects. Estimates are based on:

  • Information provided by the Client
  • On-site measurements and assessments
  • Current material costs and availability
  • Project scope as discussed during consultation

Quote Validity

Written quotes are valid for 30 days from the date of issue, unless otherwise specified. Material costs and availability may change, which could affect pricing after this period.

Quote Acceptance

A quote becomes a binding contract when:

  • The Client signs the written agreement for work
  • A deposit is received (if required)
  • Both parties have agreed to the scope of work and timeline

Pricing and Payment

Our Pricing Commitment

Modern Floorzz is committed to upfront, honest pricing with no hidden fees or gimmicky pricing strategies. All costs will be clearly outlined in your written quote.

Payment Terms

  • Payment schedules will be specified in your contract
  • We accept cash, checks, and major credit cards
  • Final payment is due upon project completion and your satisfaction
  • For large commercial projects, payment milestones may be established

Deposits

Depending on project size and material costs, a deposit may be required to:

  • Order custom or special-order materials
  • Reserve installation dates
  • Cover initial project costs

Deposit amounts will be clearly specified in your contract or via written communication

Additional Costs

Additional charges may apply only if:

  • You request changes to the project scope after contract signing
  • Unforeseen structural issues of the property are discovered that require remediation or repair
  • Additional materials are needed due to Client-requested changes

Any additional costs will be discussed and approved by you before work proceeds.

Project Timeline and Scheduling

Installation Scheduling

We will work with you to establish a mutually agreeable installation schedule. Timelines depend on:

  • Material availability and delivery
  • Project size and complexity
  • Weather conditions (for applicable projects)
  • Subfloor preparation requirements

Delays

We strive to complete all projects on schedule. However, delays may occur due to:

  • Material shipping delays from manufacturers
  • Unforeseen site conditions requiring additional preparation
  • Weather conditions affecting material delivery or installation
  • Client-requested changes or postponements

We will communicate promptly about any delays and work to minimize impact on your timeline.

Client Responsibilities

To ensure timely project completion, Clients are responsible for:

  • Providing clear access to work areas
  • Provide electrical power to the jobsite
  • Removing personal items and breakables from work areas
  • Arranging for pets to be secured away from work areas
  • Ensuring utilities (electricity, water) are available
  • Being available for final walk-through and approval

Material Selection and Warranties

Material Selection

Clients are responsible for final material selection, including:

  • Flooring type, color, and style
  • Reviewing and approving samples
  • Understanding product characteristics and maintenance requirements

We will provide professional guidance, but final decisions rest with the Client.

Manufacturer Warranties

Flooring products come with manufacturer warranties that vary by brand and product. We will provide warranty information for your selected materials. Manufacturer warranties are subject to:

  • Proper installation per manufacturer specifications (which we guarantee)
  • Proper maintenance and care by the Client
  • Manufacturer terms and conditions

Installation Warranty

Modern Floorzz warrants our installation workmanship for a period of two years.

This warranty covers:

  • Defects from installation workmanship
  • Installation-related failures or issues

This warranty does not cover:

  • Damage from misuse, abuse, or accidents
  • Normal wear and tear
  • Damage from water, fire, or natural disasters
  • Damage from improper maintenance
  • Flooring materials themselves (covered by manufacturer warranty)

Subfloor Preparation

Assessment

We will assess subfloor conditions during our initial consultation. If subfloor preparation or repairs are needed, we will:

  • Clearly outline required work
  • Provide transparent pricing for preparation services
  • Explain why preparation is necessary for proper installation
  • Allow Client to hire a third-party contractor to perform subfloor repairs
  • Asbestos remediation is required before we install new floor.

Client Authorization

Subfloor preparation work will only be performed with your authorization and will be added in your contract and pricing for the original scope of work.

Changes to Project Scope

Change Orders

If you wish to make changes to the project after contract signing, we will:

  • Provide a written change order detailing the modifications
  • Clearly state any additional costs or time required
  • Obtain your written approval before proceeding

Our Right to Refuse Changes

We reserve the right to decline changes that:

  • Violate manufacturer installation specifications
  • Compromise structural integrity
  • Create safety hazards
  • Are not feasible with selected materials

Cancellation Policy

Client Cancellation

  • Cancellations made before materials are ordered: Full refund of any deposit, minus administrative fee (if applicable)
  • Cancellations after materials are ordered: Refund of deposit minus cost of materials ordered and restocking fees (if applicable)
  • Cancellations after installation begins: No refund; payment for work completed is due

Our Cancellation Rights

We reserve the right to cancel a contract if:

  • Client fails to provide site access as agreed
  • Unsafe or hazardous conditions exist that cannot be remediated
  • Client fails to make required payments
  • Client engages in abusive or threatening behavior toward our staff

Limitation of Liability

Modern Floorzz’s liability is limited to the cost of the flooring installation services provided. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of use of property
  • Personal injury not caused by our negligence
  • Damage to property not directly related to our installation work
  • Pre-existing conditions or hidden defects in subfloors or structures

Property Damage and Insurance

While we take every precaution to protect your property:

  • We are not responsible for damage to utilities, pipes, or wiring that are not visible or disclosed prior to work
  • We carry general liability insurance for protection against accidents
  • Clients should notify us of any special concerns or fragile items before work begins
  • Any damage caused by our negligence will be addressed promptly and professionally

Client Property and Furniture

Furniture Moving

Unless specifically included in your contract:

  • Clients are responsible for moving furniture and personal items
  • We can recommend professional movers if needed
  • Basic Medium to Small furniture moving may be available for an additional fee

Property Security

  • Clients are responsible for securing valuables and personal items
  • We are not responsible for loss or damage to personal property not related to our installation work

Permits and Compliance

  • Modern Floorzz will ensure all work complies with local building codes
  • If permits are required for your project, responsibility for obtaining permits will be specified in your contract
  • Clients are responsible for disclosing any HOA or property management requirements

Dispute Resolution

Communication First

We are committed to customer satisfaction. If you have any concerns:

  • We will work diligently to resolve issues promptly and professionally

Mediation

If a dispute cannot be resolved through direct communication, both parties agree to attempt resolution through mediation before pursuing legal action.

Governing Law

These Terms are governed by the laws of the State of Arizona. Any legal action must be brought in the courts of Maricopa County, Arizona.

Independent Contractors

Any subcontractors or installers working on your project are under the direction and supervision of Modern Floorzz and are our responsibility.

Intellectual Property

All quotes, designs, project plans, and proprietary information provided by Modern Floorzz remain our intellectual property unless otherwise specified in writing.

Photography and Marketing

We may request permission to photograph completed projects for marketing purposes. We will:

  • Always request your permission before photographing
  • Respect your privacy and preferences
  • Not disclose your personal information in marketing materials

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with your signed contract and quote, constitute the entire agreement between you and Modern Floorzz regarding your flooring project.

Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted with a new “Last Updated” date. Modifications apply to contracts entered into after the update date.
